1. Terms of Sale
1.1 These terms of sale set out the terms and conditions that apply to all purchases of tickets from the website. If you purchase a ticket from the website, you are deemed to have accepted these terms of sale and agreed to be bound by them.
1.2 We reserve the right to vary these terms of sale at any time. Any variation will be effective immediately upon posting of the amended terms of sale on the website. On purchasing tickets from the website after this date, you agree to be bound by the amended terms of sale.
2. Ticketspace as Agent
2.1 We sell tickets as an agent for and on behalf of the presenter. Any representations made by the presenter with reference to the event and any associated claims or complaints are the responsibility of the presenter and not us.
2.2 All tickets are subject to the presenter’s terms and conditions of sale. It is your responsibility to ensure that you are familiar with the presenter’s terms and conditions. We can provide you with a copy of the presenter’s terms and conditions on request.
2.3 If there is any inconsistency between these terms of sale and the presenter’s terms and conditions, or these terms of sale are silent on an issue, then the presenter’s terms and conditions will prevail to the extent of such inconsistency / silence.
2.4 Each ticket is a license granted to you by the presenter to attend the event. Your contractual relationship is therefore with the presenter in terms of attendance at the event.
3. Currency and Pricing
3.1 All ticket prices are stated in New Zealand Dollars (NZ$) unless otherwise stated.
3.2 All prices include GST unless otherwise stated
3.3 Where concessions are applicable, valid identification must be provided for collection of tickets and upon entry at the event venue. The presenter reserves the right to refuse admission if valid identification is not provided.
4. Availability
4.1 We do not set the ticket prices or determine seating locations as tickets are sold on behalf of presenters. Tickets are generally sold through several distribution points, including online, participating outlets and box offices. As most distribution points generally access the same ticketing inventory, tickets for popular events may sell out quickly. We do not control this inventory or its availability.
5. Order Confirmation
5.1 When you complete a purchase online, you will receive a confirmation email. This will enable you to access your tickets to print them. If you do not receive this email then it is your responsibility to contact us to inform us. If you do not inform us that you have not received confirmation, we will be unable to guarantee that your purchase was successful. This may result in you being unable to purchase tickets if the event is sold out.
6. Booking Fees
6.1 All tickets purchased through the website are subject to a booking fee.
6.2 Some tickets may also be subject to a delivery fee.
7. Lost Tickets
7.1 We reserve the right to charge a fee for the replacement of allocated seating tickets.
7.2 We will not replace tickets for events without allocated seating (i.e. general admission tickets).
8. Cancelled Events
8.1 The presenter reserves the right to add, withdraw or replace any artist or performer, and to amend the event program, including date(s), prices, venue capacity and/or seating arrangements.
8.2 Occasionally, events are cancelled by the presenter due to circumstances beyond their control, such as weather conditions. Should this occur, please contact us for information on the procedure for receiving a refund for your ticket(s).
8.3 Refunds are at the sole discretion and control of the presenter. We simply facilitate any refunds on behalf of the presenter.
8.4 PayPal. It is the responsibility of the presenter to issue refunds to those purchasing tickets via PayPal. The purchaser must request the refund from the presenter directly. As payments made through PayPal are held by the presenter, Ticketspace takes no responsibility for issuing refunds through PayPal. 8.5 Refund limitations may be set by the presenter if the event is changed, relocated or rescheduled.
8.6 Delivery and booking fees are not refundable.
9. Refunds and Exchanges
9.1 Unless authorised to do so by the presenter or required by law, we do not provide refunds or exchanges on any tickets purchased. Therefore, please ensure that you carefully review your event and seat selection before processing the purchase.
9.2 If a refund is authorised by the presenter or required by law, any delivery or booking fees are not refundable.
10. Ticket Limits
10.1 Tickets may be subject to a limited number of tickets that each customer can purchase for an event. This limit will be published as part of the event information.
11. Multiple Browser Windows
11.1 When purchasing tickets online, please ensure that you are viewing the tickets using only one browser window. Viewing tickets on multiple browser windows will result in the loss of your ticket.
12. Limitation of Liability
12.1 We assume no liability for any loss of any kind arising out of your attendance at an event. Any liability arising is a matter between you and the presenter or other party.
12.2 By purchasing tickets on behalf of others, including minors, you acknowledge that those parties are aware of all terms and conditions relating to their tickets and their entry and attendance at the event.
12.3 To the fullest extent permitted by law, we exclude all responsibility and liability in relation to the event and we will not be responsible or liable for any loss, injury or damage however caused (including to any person or property), including under contract, tort, statute, product liability or otherwise, whether they be direct or indirect, special, incidental or consequential, resulting from the use of this website, your use of or the inability to use the tickets, the cancellation or postponement of the event, or for any other reason whatsoever.
13. Re-Sale of Tickets not permitted
13.1 No ticket may be resold at a premium, used for advertising, promotion or other commercial purposes without formal written authorisation from Ticketspace or the presenter. Any breach of this term will result in you or the ticket holder being refused admission or being ejected from the event.
14. Attendance
14.1 You must hold a valid ticket to attend the event. Unless tickets are purchased from an authorised sales channel, they may be voided or you may be refused admission.
14.2 Tickets purchased online are available to print by accessing the link contained in the confirmation email or by accessing your Ticketspace Account. If multiple copies of tickets are printed, only the first to be scanned will allow admission.
14.3 The presenter reserves the right to refuse admission or to eject you or the ticket holder from the event, without compensation to you, in circumstances where the presenter considers it has cause. This includes (without limitation) where tickets are lost or damaged, where you engage in conduct that unreasonably interferes with the enjoyment of the event by others (i.e. by fighting, being abusive or disorderly, hampering the conduct of the event or otherwise), and where you do not comply with the presenter’s terms and conditions.
14.4 You must comply with all security requirements of the presenter and the event venue in relation to your attendance, which may include (without limitation) you and your belongings being searched on entry, and the confiscation of any prohibited items, such as cameras and recording devices.
15. Terms and Conditions
15.1 “presenter” refers to the party presenting the event. This may include, but is not limited to, a promoter, producer, team, band or venue.
15.2 “we/us/our” are all references to Ticketspace.
15.3 “website” means and includes www.Ticketspace.co.nz, www.Ticketspace.nz and any page derived from these websites and any page owned by Ticketspace.
15.4 “you/your” are all references to you, as the purchaser of the ticket and/or attendee of the event.
Privacy Policy
1. Our Privacy Policy
1.1 We respect the privacy of all our customers who use the website to purchase tickets online. We are committed to all users to protect their personal information provided during the online sign up and transaction processes.
1.2 By accessing and using the website, you will be deemed to agree to this Privacy Policy.
1.3 This Privacy Policy is based on the Information Privacy Principles in the Privacy Act 1993.
2. Variation
2.1 We reserve the right to vary this Privacy Policy at any time. Any variation will be effective immediately upon posting of the amended Privacy Policy on the website. This Privacy Policy was last updated on 15 August 2011. By continuing to access and use the website, you agree to be bound by the amended Privacy Policy.
3. How information is collected by us
3.1 We collect personal information from you in the following ways:
(a) When you sign up as a Ticketspace Member to create a Ticketspace account and enter personal information to complete the sign-up process;
(b) When you purchase tickets through the website and enter personal information to complete the online transaction (including purchases made without a Ticketspace account);
(c) When you purchase tickets through an outlet, such as a university association or record store, and provide personal information to complete the transaction; and
(d) When you visit the website, we collect website use information such as your IP address and browser type. We also collect and retain such information using Cookies (see clause 8 below).
4. Use of information collected by us
4.1 We collect personal information (such as your name, address, phone number and email address):
(a) to ensure that the tickets you purchase are delivered to you;
(b) to contact you where we consider necessary in relation to your purchase, including, to advise you of any changes/cancellations that may occur and those which we have been made aware of; and
(c) to provide you with further information about the website, and other websites or services offered by us or third parties, which we consider may be of interest to you.
Personal financial information, such as credit card details, are collected for credit card transactions for identity verification and billing purposes.
4.2 Website use and personal information may be used to improve our business processes, such as our security, speed and information systems. We may also use such information to do internal research on your demographics, interests and behaviour to better serve you and other users.
4.3 Subject to clause 4.4, we will not disclose your personal information to presenters of events unless you sign up as a Ticketspace Member.
4.4 We may pass your personal information to:
(a) presenters of events to which you have purchased tickets to keep you informed of future events provided by those presenters. (b) a third party to provide special offers with our benefits (for example, Ticketspace reward points). Special offers will be sent by us and may be co-branded with the third party. You may opt out from receiving our special offers at any time by logging onto your Ticketspace account and updating your personal details.
4.5 At any time, we may use the information collected from the website to produce reports and summarise research data which may be shared with a third party. This data will not identify any individual personally.
4.6 At any time, we may disclose any and all information that we collect from you where we believe disclosure is appropriate to comply with law, to protect the rights, property or safety of us, our users or others, or to satisfy legal processes or governmental requests.
4.7 We will not use or disclose your personal information in any way, other than in accordance with this Privacy Policy or the Privacy Act 1993.
5. Security of information collected
5.1 We will endeavour to protect all information we collect about you. We store your personal information in an encrypted secure database, in proprietary data format which can only be read with the use of proprietary tools. The website is encrypted with a high grade 256 bit encryption authenticated by eWay.
5.2 All of our staff who have access to personal information will maintain strict confidence of such information at all times.
6. Content posted on message boards or events
6.1 The website may provide users with services, such as forums and message boards, to comment and rate events. All information disclosed by you using these features is public information and you should exercise caution if you choose to disclose any personal information through such features.
7. Your IP address
7.1 We use your IP address to help diagnose problems with our server and to administer our website. Your IP address is also used to help identify you and to gather demographic information.
8. Use of specific technologies
8.1 Cookies are pieces of information that a website transfers to your computer’s hard disk for record keeping purposes. Most web browsers are set to accept Cookies. We use Cookies to deliver content specific to your interests, to save your password so you do not have to re enter it each time you visit the website and for other purposes relating to your transactions on the website. We also use Cookies for tracking the statistics of the website to allow us to better understand our users and to improve the functionality and layout of the website. If you do not wish to receive any Cookies, you may set your browser to either prompt or refuse Cookies. Please note that rejecting Cookies will disable your browser from purchasing tickets from the website.
9. Access and correction
9.1 Under the Privacy Act 1993, you have the right to seek access to information which we hold about you and to correct that information if it is incorrect. Ticketspace Members can access and edit their information online through their Ticketspace account. Otherwise, you may access or change information that we have collected about you by placing your request in writing and sending your request to us by:

10. Third party advertisements
10.1 To provide offers that are of interest to you, we have relationships with third parties that we allow to place advertisements on the website. By visiting the website, advertisement server companies may collect information about you, such as your domain type, IP address and Clickstream information.
11. Links to other websites
11.1 We provide links to third party websites for your convenience and information. These linked sites are not under our control, and we are not responsible for the privacy practices or content of those sites. Before disclosing your personal information on any other website, we suggest that you review the privacy policy on those websites.
12. Secure online transactions
12.1 For purchases through the website, we process your credit card details securely over the internet using a PCI accredited internet payment security system. As well as our SSL encryption on the website and a secure browser at your end, we endeavour to take all measures to ensure that your credit card and anonymity are protected when you purchase from us online.
